A person can be incapacitated by a court or deemed to be incapacitated. In such cases a guardianship is established to protect the assets and well being of the incapacitated person. When a person is incapacitated Florida's courts can appoint a guardian over the person and a guardian over the property of a person.
In Florida, a parent of a minor is a natural guardian over the person. In cases where a minor child receives a sum of money (over $15,000), such as after a personal injury lawsuit, the court will want to protect the child's assets and establish a guardian over the property of the minor. This is to protect the child. When the court establishes a guardian over the property of a minor the court must review and approve the way that the money is spent until the child attains eighteen (18) years of age.
